Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/.

After approval of your comment, your profile picture is visible to the public in the context of your comment. Media If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you request a password reset, your IP address will be included in the reset email. How long we retain your data If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. By using Heart + Paw (“H+P”) Online (“H+P-O”), you agree to be bound by the following terms and conditions, which is a covenant by you in favor of H+P. H+P-O is a free service H+P provides to our clients and customers as a courtesy that allows you to connect with H+P electronically to facilitate interactions. You may use H+P-O for the sole purposes set forth herein. You may not use H+P-O for any improper purpose, including, without limitation: (a) modifying, adapting, translating, or reverse engineering any portion of H+P-O; (b) attempting to break security, access, tamper with or use any unauthorized areas of H+P-O; (c) attempting to collect or maintain any information about other users of H+P-O or other third parties for unauthorized purposes; (d) creating or transmitting unwanted electronic communications such as “spam,” or bulk commercial messages to other users or otherwise interfering with other user’s enjoyment of the service; (e) engaging in any activity that infringes or misappropriates the intellectual property, publicity, privacy or other proprietary rights of others, including patents, copyrights, trademarks, service marks, trade secrets, or any other proprietary right of H+P or any third party, or that is defamatory, objectionable, unlawful or promotes or encourages illegal activity; (f) transferring of technology, software, or other materials in violation of applicable export laws and regulations, including but not limited to the U.S. Export Administration Regulations and Executive Orders; (g) distributing any Internet viruses, worms, pinging, flooding, mail bombing, denial of service attacks, defects, Trojan horses or other items of a destructive nature; (h) accessing illegally or without authorization computers, accounts, equipment or networks belonging to H+P or another party, or attempting to penetrate security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including but not limited to port scans, stealth scans or other information-gathering activity; or (i) using H+P-O for any unlawful, harassing, abusive, criminal, or fraudulent purpose. H+P has the right to monitor, intercept and disclose any transmissions over or using our facilities, and to provide user information or use records, and other related information under certain circumstances (for example, in response to lawful process, orders, subpoenas, or warrants, or to protect our rights, users or property).

H+P uses reasonable organizational, technical, and administrative measures to protect personal information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us.

H+P-O collects information about the location of your device. You must first provide permission through your device before our mobile applications obtain such location information from technologies like GPS, Wi-Fi, or cell tower proximity (or a combination of these technologies). H+P-O, and our service providers, may use and store this information, in combination with other location-based information such as IP address and billing, to provide enhanced location-based services, such as store-specific services, search results, and other content. You can stop all collection of information by our mobile applications easily by uninstalling the mobile applications. Also, you may opt-out from further allowing H+P-O to have access to your location data by adjusting the permissions in your mobile device.

You are responsible for your devices and accounts. You are responsible for any devices, software, and services needed to use H+P-O services. H + P does not guarantee that the online services will fully function on any particular device or with any particular software. You are also responsible for any messaging and data charges, fees, and taxes for your use of the online services, including when we communicate with you by text, email, or other means that you choose. You may only use H+P-O with devices that you own or control and using only the authorized operating system. If you create an online services account, you are responsible for keeping the account secure and for all activity under the account. You can only use one online services account and must keep your account information accurate at all times.

Without liability to you, any user, or any third party, H+P may modify or terminate H+P-O, your access, or these Terms and Conditions for any reason, including the right to terminate with or without notice. Upon such termination, any and all rights granted by H+P to you shall terminate.

Use of H+P-O is at your own risk. H+P-O is provided on an “as is” and “as available” basis. H+P does not make, and hereby disclaims, any and all express and implied warranties or conditions of any kind, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, noninfringement and title and any warranties that arise from course of dealing, usage, or trade practice. H+P does not warrant that the services will perform at a particular speed, or will be uninterrupted, error-free, or secure.

H+P is not liable for any damages, losses, expenses, or costs that you suffer in connection with your use of H+P-O, including, but not limited to: (i) any interruption or failure of H+P-O; (ii) the downloading or use of any information, data or materials obtained via H+P-O; (iii) any failure to complete a transaction on the Internet or using H+P-O or any loss of data due to delays, non-deliveries, misdeliveries, or service interruptions; (iv) anything beyond the reasonable control of H+P, including but not limited to interruption or failure of a third party’s services, software, equipment or network; (v) any unauthorized use or modification of H+P-O or combination of the use of H+P-O with other services, products or equipment; (vi) viruses, worms, trojan horses, or other undesirable data or software; or (vii) the attempt by unauthorized users (e.g., hackers) to obtain access to your data, website, computers, or networks.

You, as a user, acknowledge that by signing up, you agree to these Terms and Conditions. You further agree to indemnify and hold harmless H+P, its suppliers and licensors, from and against any and all losses or claims arising from or in any way related to your use of H+P-O or any breach of these Terms and Conditions. Your authorization to utilize H+P-O is dependent upon your full compliance with these Terms and Conditions.
